The Federal Trade Commission (FTC) has launched an investigation into OpenAI, the developer of the ChatGPT chatbot, to assess potential harm caused by its AI system’s dissemination of false information about individuals. The FTC has issued a civil investigative demand to OpenAI, focusing on various areas such as AI model training practices, user data handling, and marketing efforts.

The demand includes inquiries about the measures taken by OpenAI to address or mitigate the risks associated with its large language models producing false, misleading, or disparaging statements about real individuals. The FTC’s jurisdiction empowers it to address unfair and deceptive business practices, and Chair Lina Khan has expressed a commitment to scrutinizing both the deceptive practices of scammers and the enabling actions of upstream companies within the AI landscape.

The emergence of generative AI has introduced new threats to the information ecosystem, as the technology’s ability to create lifelike and believable content challenges traditional defense mechanisms against misinformation. Regulators responsible for consumer safety are now formulating strategies to address this evolving landscape.

OpenAI CEO Sam Altman has acknowledged the potential risks of AI technology going awry and has expressed a willingness to collaborate with the government to prevent such occurrences. However, until regulations are in place, the power of AI continues to impact real-life scenarios, making misinformation and disinformation a significant concern.

The absence of dedicated regulation or policy guardrails for AI models in the US has led to rapid scaling and commercialization without clear guidelines. As AI capabilities advance, the stakes surrounding misinformation grow, emphasizing the need for regulatory intervention.

OpenAI is engaging with regulators in the US and Europe, advocating for a more centralized and specialized approach in the US while expressing concerns about certain data-privacy regulations in the EU. The company has called for coordinated development efforts, international monitoring of AI development, and technical measures to ensure the safety of superintelligence.

While consumers struggle to identify misinformation in a fast-paced content landscape, regulatory agencies face the pressing challenge of establishing frameworks to address AI-generated falsehoods. The investigation into OpenAI by the FTC signals a growing recognition of the risks associated with AI-generated misinformation and the need for proactive measures to mitigate its impact.
