Nigerian Communications Commission Warns Telemarketers of Prosecution for Unauthorized Subscriber Data Use

The Nigerian Communications Commission (NCC) has issued a stern warning that it will pursue legal action against telemarketers engaged in the illegal acquisition of telecom subscribers’ phone numbers for commercial purposes.

The NCC firmly refuted claims that telemarketers had obtained telecom consumers’ phone numbers directly from the commission, branding such allegations as untrue. This clarification was made via a public notice titled ‘Unauthorised use of telecom subscribers’ phone numbers and other personal information by telemarketers.’ The notice was signed by the Executive Vice Chairman of the NCC, Prof. Umar Danbatta.

The commission emphasized its strict adherence to the established principles and regulations governing the protection of telecommunications consumers’ privacy. It underscored that no service provider or telemarketer had the authorization to invade, collect, or exploit subscriber data in any manner without explicit consent from the consumer, unless otherwise dictated by legal provisions.

The NCC cited the legal frameworks supporting subscriber data protection, including Section 35 (1) of the Consumer Code of Practice Regulations (2007), Section 9 (1) of the Nigerian Communications (Registration of Communications Subscribers) Regulations (2022), and Section 4.2 (a) & (b) of the NCC’s Internet Code of Practice.

Consequently, the NCC issued a strong warning to any telemarketers who engage in the unethical practice of acquiring telecom subscribers’ phone numbers and personal information through deceitful means and exploiting such data for commercial purposes without regulatory approval. Such individuals were cautioned to cease their unlawful activities, with a clear statement that violators would face arrest and prosecution as per the law.

The NCC encouraged telecom consumers to utilize the Do-Not-Disturb short code, introduced by the commission, to manage their subscriptions to Value Added Services. This service provides consumers with the option to halt unsolicited text messages and other telemarketing offers by sending “STOP” to the 2442 Short Code for FULL DND.

Furthermore, the NCC urged telecom consumers to report any instances of these illegal activities by telemarketers to the commission. To facilitate such reports, consumers can utilize the NCC’s Toll-Free Number, 622, which will prompt necessary enforcement actions.
