Nigeria: Corruption Allegations Against Malami Under Investigation by ICPC

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) is currently investigating allegations of corruption and abuse of office against Abubakar Malami, the former Attorney-General of the Federation and Minister of Justice. The investigation comes in response to a petition filed by the Human and Environmental Development Agenda (HEDA), outlining accusations of corruption and misuse of authority against Malami.

The memo, dated July 19, 2023, and signed by the Petition Registrar of ICPC, H.S. Folaranmi, stated, “I am directed to acknowledge the receipt of your petition on the above subject and to inform you that necessary action is being taken on the matter.”

In its petition to the ICPC, HEDA, led by its Chairman Olanrewaju Suraju, highlighted several allegations against Malami, including:

1. **Distribution of Car Gifts:** On May 2, 2022, it was reported that Malami distributed 30 car gifts worth over N1 billion to supporters in Kebbi State. These gifts included 14 Mercedes Benz, eight Prado SUVs, four Toyota Hilux, and four Lexus LX. Beneficiaries were reported to be social media influencers, members of Malami’s foundation, and women support groups.

2. **Illegal Auctioning of Seized Crude Oil Vessels:** Malami allegedly authorized the sale of sea vessels holding seized crude oil, contravening Section 31(2) and (4) of the EFCC Act 2004. The vessels were sold by companies under EFCC prosecution for illegal bunkering. This action was confirmed by the AGF’s Media Assistant, who cited the presumption of innocence for the accused.

3. **Duplication of Legal Fees:** Malami reportedly paid $16.9 million in legal fees to two new lawyers for the recovery of funds linked to Sani Abacha, despite a Swiss lawyer, Enrico Monfrini, having already completed his work and being paid by the previous government for the same purpose.

ICPC’s move to investigate these allegations underscores its commitment to addressing corruption and upholding the rule of law in Nigeria.
